Trademark and Logo Usage Terms and Conditions for inx Technology Products.
1. Definitions
“Company” refers to inxware and its affiliates.
“Partners” refers to authorized participants in the inxware Developer Partner Program who have executed a partner agreement with the Company.
“Community Users” refers to non-partner users of inxware community products and services.
“Trademarks” refers to all trademarks, service marks, logos, and trade names owned by the Company, including but not limited to “inxware,” “Lucid,” and associated logos and icons.
“Inx Technology Products” refers to inx’s current and future products, including all inxware prefixed products, Lucid, Appland, inxware Component Builder IDE Plugin, Devman.
2. Partner Trademark Usage Rights
2.1 Authorized Partner Marks
Partners in good standing may use the following trademarked references and associated icons:
- “Powered by inxware”
- “inxware Developer Partner”
- “Built with Lucid”
2.2 Partner Usage Requirements
Partners must:
- Use marks exactly as provided in official brand guidelines
- Ensure usage does not imply endorsement beyond the partnership relationship
- Include appropriate trademark notices (® or ™) as specified
- Submit materials for pre-approval if required by partner agreement
- Maintain current partner status and comply with all partner terms
2.3 Partner Restrictions
Partners may not:
- Modify, alter, or create derivative versions of the marks
- Use marks as part of their own company name or domain name
- Use marks in a manner that suggests ownership of the trademarks
- Continue using partner-specific marks after termination of partner status
3. Community User Trademark Usage Rights
3.1 Authorized Community Marks
Community Users may use the following trademarked references:
- “Powered by the inxware community”
- “Built with Lucid community edition”
3.2 Community Usage Requirements
Community Users must:
- Use marks solely to indicate use of inxware community products
- Use marks exactly as specified without modification
- Include appropriate trademark notices when feasible
- Ensure usage is truthful and not misleading
3.3 Community Restrictions
Community Users may not:
- Use partner-specific marks (“Powered by inxware,” “inxware Developer Partner,” “Built with Lucid”)
- Modify or alter the approved community marks
- Use marks in a way that suggests official partnership or endorsement
- Use marks for commercial advantage beyond indicating product usage
4. General Usage Guidelines
4.1 Quality Standards
All usage must:
- Maintain the reputation and goodwill of the Company
- Comply with applicable laws and regulations
- Follow brand guidelines regarding size, placement, and appearance
- Avoid association with inappropriate or offensive content
4.2 Prohibited Uses
All users are prohibited from:
- Using marks in a disparaging or negative context
- Using marks to promote competing products or services
- Using marks in violation of intellectual property rights
- Using marks in spam, unsolicited communications, or deceptive practices
5. Intellectual Property Rights
5.1 Ownership
All trademarks remain the exclusive property of the Company. No ownership rights are transferred through this license.
5.2 Goodwill
All goodwill generated through authorized use of the marks shall inure to the benefit of the Company.
6. Compliance and Enforcement
6.1 Monitoring
The Company reserves the right to monitor usage and request proof of compliance with these terms.
6.2 Violation Remedies
Upon violation of these terms, the Company may:
- Require immediate cessation of trademark use
- Demand removal of infringing materials
- Terminate usage rights without notice
- Pursue legal remedies for trademark infringement
7. Termination
7.1 Termination Events
Usage rights terminate immediately upon:
- Violation of these terms and conditions
- Termination of partner status (reverts to Community User terms & condition)
- Discontinuation of community product use (for Community Users)
- Direct notice from the Company
7.2 Post-Termination Obligations
Upon termination, users must:
- Immediately cease all use of the trademarks
- Remove all materials containing the marks
- Destroy any materials containing the marks in their possession
8. Disclaimer and Limitation of Liability
8.1 No Warranty
The Company provides no warranty regarding the trademarks and disclaims all liability for their use.
8.2 Indemnification
Users agree to indemnify and hold harmless the Company from any claims arising from their use of the trademarks.
9. Modifications
The Company reserves the right to modify these terms at any time. Continued use of the trademarks constitutes acceptance of modified terms.
10. Governing Law
These terms are governed by the laws of England and Wales without regard to conflict of law principles.
